General Delivery Terms and Conditions of Aquasonic Soundfloating
Valid from the opening date, March 22, 2025
1. Definitions
1.1. Client: A natural person or legal entity who books and participates in a Soundfloating session with Aquasonic or purchases a related product or service offered by Aquasonic.
1.2. Parties: The Client and Aquasonic.
1.3. Soundfloating Session: A service provided by Aquasonic in which the client floats in a warm saltwater bath while sound vibrations are applied to the client’s body through an underwater speaker. Where feasible and desired, this may be accompanied by music. The session is preceded by an intake conversation to ensure a tailored experience that can contribute to the client’s overall health and well-being. The session can either stand alone or be part of a series.
2. Applicability
2.1 These Terms and Conditions apply to all services, whether paid or free, offered by Aquasonic Soundfloating and to all agreements in which Aquasonic is a party.
2.2 By registering for a Soundfloating session or purchasing a related product or service offered by Aquasonic, the client confirms their agreement to the applicability and content of these Terms and Conditions by confirming their booking.
3. Formation of the Agreement Between Client and Aquasonic
3.1 The agreement between the client and Aquasonic is established when the client books a Soundfloating session themselves via www.aquasonic-soundfloating.com, or when they make an appointment with an Aquasonic representative via email or phone.
3.2 After booking an appointment, the client will receive a confirmation email specifying the agreed time and location. The confirmation email will also reference the Terms and Conditions of Aquasonic.
4. Aquasonic's Obligations
4.1 An Aquasonic representative will conduct a Soundfloating session to the best of their knowledge and ability.
4.2 The products and services offered by Aquasonic are not intended to provide medical care, treatment, or medication as defined under the Dutch Healthcare Professions Act (Wet Beroepen in de Gezondheidszorg). Through a Soundfloating session, Aquasonic aims to provide an experience that can contribute to the client’s overall health and well-being.
4.3 Aquasonic ensures suitable, safe, and hygienic conditions for the preparation, execution, and completion of the Soundfloating session.
4.4 After each session, the water in the Soundfloating bath is cleaned in accordance with the procedure described on the website.
4.5 If the client has questions following the session or within fourteen days thereafter, they may contact Aquasonic by phone, email, or in writing.
5. Client Responsibilities
5.1 The client guarantees the accuracy of the information provided during registration. The client assumes full responsibility for any consequences, whether direct or indirect, arising from incorrect or delayed provision of information that could reasonably be deemed important for the proper execution of the Soundfloating session. Such information can be shared via email or phone prior to the session, or verbally during the intake.
5.2 The client must arrive on time for their appointment.
5.3 The client acknowledges having read and accepted Aquasonic’s Terms and Conditions, which apply to the Soundfloating session.
6. Confidentiality, Privacy, and Personal Data Processing
6.1 Both parties acknowledge that the nature of their relationship, as well as any data and information shared within the context of the Soundfloating session and its execution, is strictly confidential.
6.2 Neither party shall disclose, directly or indirectly, the nature of the relationship or any data and information obtained to third parties.
6.3 The obligations outlined in Sections 6.1 and 6.2 apply both during and after the Soundfloating session.
6.4 Your privacy is important to us. Please refer to our privacy statement for details on how we safeguard it.
6.5 In accordance with the General Data Protection Regulation (GDPR), clients have the right to access, correct, and/or delete their personal data. Clients may exercise this right by submitting a request via email to Aquasonic at: info@aquasonic-soundfloating.com.
7. Cancellation by the Client
If the client is unable to attend a scheduled Soundfloating session, they must notify Aquasonic as soon as possible. The following conditions apply:
7.1 If the cancellation or rescheduling is made no later than 24 hours before the appointment, the client can cancel or reschedule the Soundfloating session free of charge.
7.2 If the cancellation or rescheduling is made less than 24 hours before the appointment, the client is obligated to pay the full amount for the session to Aquasonic. Aquasonic will send the client an invoice for this amount within seven days.
7.3 If the client does not show up for the scheduled Soundfloating session, they are obligated to pay the full amount for the session to Aquasonic. Aquasonic will send the client an invoice for this amount within seven days.
7.4 If the client arrives more than five minutes late to the location, Aquasonic reserves the right to reduce the session time accordingly while charging the full fee for the session. If Aquasonic determines that a meaningful session is no longer feasible within the remaining time, the conditions outlined in Section 7.3 will apply.
7.5 If the client is unexpectedly unable to attend, the Soundfloating session may be transferred to a third party. The client must inform Aquasonic of this transfer in a timely manner via email.
8. Cancellation by Aquasonic
8.1 Aquasonic reserves the right to cancel sessions in cases of force majeure or employee illness, where it is not reasonably possible to find an equivalent replacement. In such cases, the client’s payment obligation is waived.
8.2 In the event of emergencies at the Aquasonic location, Aquasonic may cancel the appointment, and the client’s payment obligation is waived.
9. Payment
9.1 Aquasonic lists all prices for Soundfloating sessions and related products and services on www.aquasonic-soundfloating.com or sends the prices to the client by email.
9.2 The listed prices include the applicable VAT rates.
9.3 Offers made via the website, social media, or advertisements are only valid within the specified duration.
9.4 Aquasonic reserves the right to change the prices for services, products, and memberships. For orders of services and products, the prices at the time of the order apply. For memberships, the prices at the time of subscribing to the membership apply.
9.5 When the client makes an appointment, they can pay the invoice directly online through the booking system on www.aquasonic-soundfloating.com. Alternatively, the client can pay the invoice via card payment after the Soundfloating session.
10. Website
10.1 Access to the website is free for all users with internet access. Aquasonic makes efforts to ensure the website is available 24 hours a day, 7 days a week but does not provide any guarantees regarding availability.
10.2 Aquasonic is not responsible for any poor accessibility or unavailability of the website.
10.3 Aquasonic reserves the right to interrupt access to the website to perform any necessary maintenance to ensure the proper functioning of the website.
11. Email
To keep clients informed about relevant developments, Aquasonic sends periodic emails to these individuals as a service. The recipient can unsubscribe from this service via a link provided in the email.
12. Liability
12.1 Participation in an Aquasonic Soundfloating session is entirely at the client's own risk.
12.2 Aquasonic is not liable for any damage, whether direct or indirect, arising from the client's failure to comply with any of the obligations outlined in the Terms of Use.
12.3 Aquasonic is not liable for the use of the website for purposes other than those described in these terms.
12.4 Aquasonic is not liable for the use of the information on the website.
12.5 Aquasonic is not liable for any damage of any kind arising from the Aquasonic staff relying on inaccurate and/or incomplete information provided by the client regarding physical and/or mental conditions, medication use, work, leisure activities, or other relevant matters.
12.6 Aquasonic is not liable for any loss, theft, or damage to personal property brought by the client to the Aquasonic location.
12.7 The client indemnifies Aquasonic against any claims for damage as described in clause 12.
12.8 Liability for damage caused by force majeure and/or cancellation by Aquasonic is excluded.
12.9 Any potential liability of Aquasonic is at all times limited to the amount paid out under Aquasonic's professional liability insurance in the relevant case. If Aquasonic's insurer does not pay out, Aquasonic's liability is limited to the maximum amount invoiced for the service provided, or at least the portion of the invoice to which the liability applies.
13. Training Materials/Intellectual Property Rights
13.1 All text, image, and audio materials produced and/or made available by Aquasonic, including but not limited to sound recordings, video recordings, photography, brochures, (hand)books, e-books, podcasts, presentations, and publications, are and will remain the intellectual property of Aquasonic, regardless of the nature of these materials.
13.2 Without the explicit prior written consent of Aquasonic, the client is not permitted to publish or reproduce, or distribute in any way, these materials or parts thereof.
13.3 Media publications about the content of the Soundfloating sessions, and media publications using the materials described in clause 13.1, are only permitted with prior written consent from Aquasonic.
13.4 The trademarks "Aquasonic," "Soundfloating," and "Aquasonic Soundfloating," as well as the associated text, images, photos, audio, and video components, are the exclusive property of Aquasonic and are registered as such.
14. Complaints
14.1 Complaints must be submitted in writing to Aquasonic within eight days.
14.2 Complaints about the execution of the Soundfloating session must be submitted to Aquasonic in a timely, complete, and clear manner after the client has identified the issues.
14.3 Complaints submitted to Aquasonic will be recorded and responded to within fourteen days of receipt. They will be treated confidentially by both parties. If a complaint requires a foreseeable longer processing time, Aquasonic will acknowledge receipt within fourteen days and provide an indication of when the client can expect a more detailed response.
14.4 Aquasonic will inform the complainant in writing and with justification of the findings of the investigation into the complaint, as well as any conclusions Aquasonic draws from it.
14.5 As a general rule, Aquasonic assumes that a mutually suitable solution for the complaint will be reached through good communication and consultation between both parties.
15. Amendment Clause
15.1 Aquasonic reserves the right to unilaterally modify the terms and conditions. The most recent version of the terms and conditions is valid and can be consulted at any time on the website. Any changes will be implemented on this page. It is the responsibility of the visitor and client to stay informed of the latest version of the Terms and Conditions.
16. Disputes
16.1 Dutch law applies to all agreements between the client and Aquasonic to which these Terms and Conditions apply, regardless of the country of origin of the visitor/client or the country from which the visitor/client has accessed the website.
16.2 The court located in the place of establishment of Aquasonic shall have exclusive jurisdiction to adjudicate any disputes arising from the agreements made between the client and Aquasonic, including the collection of amounts owed. Currently, this is in The Hague.
16.3 As a general rule, Aquasonic assumes that a mutually suitable solution for the dispute will be reached through good communication and consultation between both parties. Nevertheless, for such cases, Aquasonic is affiliated with the Disputes Committee for Consumer Affairs.
